Presidential Election Judgement And Implications Of The 37th State

The  judgements of the Presidential Election Petition Court just delivered last week, precisely on Wednesday, September 6, 2023 are expectedly the predominant and trending issue in the Nigerian polity. We do not intend to do an  intensive analysis of the judgments here today considering the fact that our final position is circumscribed by the decisions of organisations to which we subscribe in membership, principles and ideologies.

It, however, suffices to say that the judgements, as one, is a landmark in its most damaging revisionist dimensions for our laws generally, election jurisprudence in particular and for the Nigerian polity and politics. It did not require much literacy from anyone listening to the delivery of the judgement to decipher from the very beginning that the petitions were really undergoing butchery rather than any forensic legal analysis that may lead to justice.

Whither The Nigerian President?

Nigerians are so shell-shocked at the degree of lawlessness that characterised the 2023 elections, wondering if this country is still under any government which is symbolised in the President. As the head of state, President Muhammad Buhari has nowhere to pass the buck, especially of the orgy of violence during the elections in all parts of the nation. He is inexorably accountable. The Presidential and National Assembly elections of February 25 set the tone for the horrendous occurrences during the gubernatorial election which was initially slated for March 11, but postponed by one week.

Some of us had thought it was mischievous, as some suggests that the real reason for the shift was to buy time  for those caught unawares during the first elections to redeem their losses by all means. We were proved wrong. Even at that, Nigerians were still hopeful that the Independent National Electoral Commission, INEC, and particularly its Chairman, would strive to prove pessimists wrong that its sole agenda was to deliver the country to the ruling part unashamedly.

President Muhammadu Buhari has stated for the umpteenth time that he desires to bequeath the country a legacy of credible elections. That seems to be the only low hanging fruit waiting for him to pluck as his disastrous presidency comes to an insalubrious end on May 29. He has made the promise not only to Nigerians but also the international community.

While commissioning a wide range of operational assets acquired by his administration to strategically improve the capabilities of the police, particularly in crowd control and anti-riot operations, on February 13, the president harped on the need for them to be professional while policing the elections.
