The Wages Of INEC

“Truth must be told, the non-transmission of results to the IReV portal may also reduce the confidence of the voting population in the electoral process.” – Hon Justice Inyang Okoro, Justice of the Supreme Court of Nigeria.

These are words on marble, coming from the highest court of the land. They simply summarise the failure of the Independent National Electoral Commission (INEC) during the 2023 general election and they remain indelible marks on the record and history of the electoral umpire.

We have now gradually come to the reality of the bastardy of democracy. An institution established to strengthen democracy is daily eroding it, through crooked elections, dribbling tactics and electoral malfeasance.

Nigeria: Justice For Sale?

Increasingly but alarmingly, it is gaining ground that Nigerians now believe that justice is for sale. This position seems to be gaining ground increasingly. Is it possible to buy justice? Is it true that some politicians have all manners of mobile injunctions already typed and prepared, stocked in their portfolios and they just bring them out to suit any occasion?

Can it be true that there are some judges who have been earmarked for such jobs as issuing out any order, injunction or judgment? Can it ever be said that parties before a court of law can know their fate even before the case starts?  

Crisis Of Insecurity As Challenge Of Development

Security of lives and property has been accorded priority attention by governments of different countries of the world, be it democratic or military administration. This is so because an atmosphere devoid of fear, anxiety, threat, harm, etc to citizens’ lives and property will only bring about socio-economic development.

In other words, development cannot thrive in the atmosphere of conflicts, violence, anxiety, fear and wanton destruction of lives and property, as it is currently the case in many parts of Nigeria. Therefore, it follows that there is a strong link between security and development in any social setting.

INEC And Controversial Elections

Year in and year out, the Independent National Electoral Commission, INEC, conducts elections into various offices in Nigeria, either through the main general elections, the bye-elections or other elections. INEC has been involved in the conduct of elections for an unbroken period of twenty-four years on, from 1999 to 2023. It would seem however that there is still a lot to do to get the electoral umpire moving. For sure, INEC is the only statutory body authorised to organise or conduct elections in Nigeria, in respect of certain offices created by the Constitution.

INEC is one of the federal executive agencies of the State established under section 153 (1) of the 1999 Constitution as amended, with its functions stated in paragraph 15 of the Third Schedule of the said Constitution. Under and by virtue of paragraph 14 of the said Third Schedule, the Chairman of INEC should be at least forty years old, he must be non-partisan, he must not be a member of a political party and he must be a person of unquestionable integrity.

Awake, O Judiciary!

On Friday March 3, 2023, the nation waited with bated breath for the Supreme Court, the crowning glory and head of Nigeria’s judicial system.

The apex court is populated with leaders of the judiciary, starting from the Honourable the Chief Justice of the Federation, who also heads the National Judicial Council. It had been a long wait indeed, essentially because on February 8, 2023, the Supreme Court gave a lifeline to the suffering masses of our people when it issued an order for the old N200, N500 and N1000 notes to continue to circulate alongside the new notes. But the federal government and the Central Bank of Nigeria would have none of it, insisting that the old N500 and N1000 notes were gone forever as they had ceased to be legal tender.

Is Buhari A Nigerian?

The President of any country is the number one citizen of that nation, all things being equal. He is first amongst equals, being the one that all other citizens look up to for leadership and direction. The President is the first ambassador of the nation and so the rest of the world views the country through the President. It is no wonder therefore that most laws defining the qualifications of those who aspire to the office of the President have a major requirement that the aspirant must be a citizen of the country; he must carry the life and blood of the nation, which would be the engine of the patriotism that he takes with him to that exalted office.

You can imagine the embarrassment it will cause any nation to discover that its President is a foreigner! In Nigeria, under and by virtue of section 131 (1) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), ‘a person shall be qualified for election to the office of President if (a) he is a citizen of Nigeria by birth’. It is therefore an anathema for anyone to aspire to be elected as the President of Nigeria when he is not a Nigerian citizen through the bloodline.

The Constitution is deliberate in putting emphasis on the phrase ‘a citizen of Nigeria by birth’. In other words, Nigeria must run in the blood of the President and not just any type of citizenship. This is so because by virtue of section 26 of the Constitution, you can become a Nigerian citizen other than by birth, through registration or naturalization, but this category of citizens cannot aspire to lead Nigeria as its President. So, if it can be proved that anyone occupying the position of President of Nigeria is not a citizen of Nigeria by birth, then his presidency can be queried.

Nigeria: A Nation In Darkness

For the umpteenth time, the epileptic national grid collapsed over the weekend again, resulting in blackout in most parts of the country. A terse statement from the Ministry of Power attributed the collapse to “the partial shutdown of the Oben gas plant to address the repair of critical gas processing equipment. The incident unfortunately occurred at a time when other power plants on other gas sources are undergoing planned maintenance and capacity testing.” 

You cannot fault this empty logic, can you? This has been the story of power supply in Nigeria and it is unlikely that things will change. In times past, we used to look forward to the rainy season because it births a temporary moment of stability in electricity generation. It is possible that this year, some supernatural forces have blocked the flow of water in all the dams, especially now that diesel sells for about N800 per litre.

Power generation is the main issue with regard to the socio-economic development of any nation. In Nigeria however, successive governments have deployed it for political gains, knowing the importance that Nigerians attach to it. Thus in 2015 when it was canvassing for votes from the electorate, the All Progressives Congress stated as follows:

The Conspiracy In Sokoto

There is need for genuine reconciliation in this matter.  

The criminal charge Criminal Conspiracy and Inciting Public Disturbance as framed by the Sokoto State Government against hardened murderers is an insult to the sensibilities of the parents of the deceased, the people of Nigeria and God who created Deborah.

This crime took place in an enlightened environment in a higher institution, under the watch of security men, who were said to have been overpowered. 

It all started from a WhatsApp group, which has identified leaders. There are students who sent messages and threats of death on that platform. Their phone numbers are registered with NIN identification. They belong to a class in the school so they are known individuals. 

Nigeria: Living In A Failed State

Last week, the Senate asked the President to declare a state of emergency on security in Nigeria. From one Senator to the other, the men and women of the Upper Chamber of the National Assembly were unanimous that something has to be done urgently, to stem the slide into anarchy, unbridled violence and bloodshed across the land.

What is the security situation presently? We have a police force lacking in legitimate leadership, the armed forces is so politicized that the leadership is loyal only to the party in power and a commander-in-chief that seems to have been totally overwhelmed with the crisis. It is by now clear to all and sundry, at least from the comments and contributions of lawmakers across party lines, that Nigeria is approaching a failed state.

This was indeed the conclusion reached at a stakeholders’ summit held last week, where Professor Pat Utomi and others x-rayed the dangerous dimension that security has taken in Nigeria. The Sultan of Sokoto said somewhere else that Boko Haram has now transformed into bandits and kidnappers. It is the latest business in town.

Joe Igbokwe’s Unprovoked Mockery Of The Judiciary

Some few minutes ago, Mr. Joe Igbokwe posted on his Facebook wall, a comment, to the effect that the Governor of Rivers State, Mr Nyesom Wike, the latter a lawyer and a member of the Body of Benchers, bought his way through the Supreme Court of Nigeria.

I was alarmed at such open declaration, given that I’m part and parcel of the Nigerian judiciary.

Consequently, I urge all lawyers, activists and lovers of the rule of law and due process, to join me to engage Mr. Joe Igbokwe on this rather reckless utterance.

Indeed, it is the height of indignity. By my last reckoning, Mr Joe Igbokwe is still a public servant, in Lagos State, the land of opportunities, being paid thorough our sweat and labour.

How can such a person paint the entire legal system of Nigeria with such conclusion as that one could buy judgment in the Supreme Court?

President Buhari’s Disappointing Broadcast

Reading through the presidential broadcast, however, one cannot but express a sense of utter disappointment. This is a president who virtually sneaked out of Nigeria, who breached his own self-declaration of transparency, by keeping Nigerians in the dark for over 100 days, and in that process grinding the wheel of progress of the nation.

President Buhari 

Notwithstanding that the president took Nigerians for granted, he was not impeached, but rather Nigerians were offering prayers for his recovery, daily, only for him to return with a language of combat and insult, describing his own citizens as "irresponsible elements"!

There must just be something about the All Progressive Congress (APC) ruling government that detests truth and consistency. Whilst the president was away, his Vice President, Prof Yemi Osinabajo, translated our freedom of expression into hate speeches and terrorism and here is the president, few days thereafter, piling up hatred and animosity upon Nigerians, who are simply demanding restructuring, true federalism and dialogue, asking the president and his party, to fulfill their campaign promises.
